1. Service Description

KlikSend allows registered users to upload files or folders securely and share them via generated links. All users must create an account and authenticate before accessing the service. Uploaded content is stored securely for a maximum of 7 calendar days, after which it is automatically and permanently deleted. We do not monitor the content of uploaded files except as required by law or in response to reports of misuse.

2. Account Creation and Security

To use KlikSend, you must register with accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately if you suspect unauthorized access to your account. KlikSend is not liable for losses arising from unauthorized use of your account unless due to KlikSend’s negligence.

3. User Responsibilities

Users are responsible for all content uploaded and shared via KlikSend. You agree not to upload, store, or distribute any content that:

• Is illegal or promotes illegal activity
• Violates intellectual property rights or confidentiality obligations
• Contains malware, ransomware, or other harmful components
• Promotes violence, hate speech, or discrimination
• Compromises the privacy or data protection rights of others

KlikSend reserves the right to suspend or terminate any account found to be in breach of these terms.

4. Privacy and Data Protection

All personal data and uploaded content are handled in accordance with our Privacy Policy, Data Retention Policy, and PAIA Manual. By using KlikSend, you consent to the collection, processing, and storage of your personal information and uploaded content as described in these policies.

5. Limitation of Liability

KlikSend provides its services on an "as is" and "as available" basis. While we implement robust security and data protection measures, we are not liable for any direct, indirect, incidental, or consequential damages arising from:

• Data loss or corruption
• Unauthorized access to your account or shared links
• Service interruptions or failures
• Any reliance on content or functionality of the service

This limitation of liability does not apply to the extent prohibited by applicable law, or where damage is caused by KlikSend’s gross negligence or willful misconduct.

6. Intellectual Property

All trademarks, logos, website content, and design elements of KlikSend are the intellectual property of Kliksend (Pty) Ltd and are protected by South African copyright laws. You retain ownership of your uploaded files but grant KlikSend a limited, non-exclusive license to store and transmit them solely for the purpose of providing the service.

7. Service Termination

KlikSend may suspend or terminate your account and access to services at any time if you violate these terms, or if required by law. You may close your account at any time by contacting us at info@kliksend.co.za.

8. Dispute Resolution and Complaints

If you have a complaint or dispute regarding KlikSend’s services, please contact us at info@kliksend.co.za. We will acknowledge your complaint within 48 hours and aim to resolve it within 14 business days. If unresolved, you may escalate the matter to the Consumer Goods and Services Ombud (CGSO) or the National Consumer Commission (NCC) in South Africa.

9. Governing Law

These terms and conditions are governed by the laws of the Republic of South Africa. Any disputes arising from your use of KlikSend will be subject to the exclusive jurisdiction of South African courts.

10. Amendments to Terms

KlikSend reserves the right to modify these terms and conditions at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the service after changes have been made constitutes your acceptance of the updated terms.
